1. Service Description

GrupoTeca acts as a digital intermediation platform in the mortgage sector, whose purpose is to facilitate users' access to favorable financing conditions by grouping applications from people with similar credit profiles. Through this grouping, GrupoTeca manages the collection of information and presentation of applications to different financial institutions to obtain mortgage financing proposals for each group of users.

GrupoTeca's role is limited exclusively to intermediation between users and banking entities, without intervening in final negotiations or loan contract formalization. Once available offers are communicated, it is up to the user to freely decide whether to continue the contracting process directly with the corresponding financial institution.

We do not provide: Financial advice, mortgage guarantees, or credit approval decisions.

Third-Party Services: GrupoTeca facilitates connections with third-party lenders. We are not responsible for lender decisions, delays, or changes to their lending criteria. Each lender operates independently.

2. Eligibility

You must:

Be at least 18 years old

Provide accurate and complete information

Have legal capacity to enter mortgage agreements

Comply with all applicable laws and regulations

By using our service, you consent to receive communications electronically. We will communicate with you by email or by posting notices on our platform. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement for written communication.

3. Cost of Service

Free for Users: Our mortgage matching service is completely free. There are no fees to use the platform or receive offers.

No Hidden Costs: You will never be charged by GrupoTeca for accessing our services, submitting applications, or receiving mortgage offers.

Offers Subject to Change: Any offer you receive is preliminary and subject to modifications when the bank fully reviews your data and documentation.

4. Withdrawal Rights (EU Consumer Protection)

Right to Cancel: You have the right to withdraw from this agreement within 14 calendar days without giving reason. Since our service is completely free, there are no financial implications to exercising this right.

How to Exercise: To exercise your withdrawal right, you must inform us of your decision by email at info@grupoteca.es or through your account settings.

Withdrawal Deadline: The withdrawal period expires 14 days from the day you accepted these terms.

Data Already Processed: If during the withdrawal period your anonymised financial data has already been shared with banking entities as part of a group negotiation, GrupoTeca cannot withdraw that data from those entities. You may contact the banks directly regarding any data they hold.

Account Deletion: Upon withdrawal, your account and personal data will be deleted in accordance with our Privacy Policy, subject to any legal retention obligations.

5. Group Formation Process

Matching: You will be matched with people with similar credit profiles.

Timeline: Groups typically form within 30-90 days. Maximum waiting period is 180 days.

Anonymity: Personal information is not shared between group members.

6. User Responsibilities

You agree to:

Provide accurate, complete, and up-to-date information

Maintain the confidentiality of your account credentials

Notify us immediately of any security breach

Not attempt to contact other group members directly

Use the service only for legitimate mortgage purposes

7. Intellectual Property Rights

Ownership:

Platform Ownership: All content, features, and functionality of the GrupoTeca platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of GRUPOTECA COMPANY LIMITED or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

License:

Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our platform solely for obtaining mortgage matching services. This license does not include any right to: (a) resell or commercial use of the platform or its content; (b) collection and use of any product listings, descriptions, or prices; (c) derivative use of the platform or its content; (d) downloading or copying of account information; or (e) use of data mining, robots, or similar data gathering tools.

Restrictions:

Usage Restrictions: You may not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit the platform or any portion thereof for commercial purposes without our express written consent. You may not frame or utilize framing techniques to enclose any trademark, logo, or proprietary information without written consent.

Trademarks:

Trademarks: 'GrupoTeca' and all related logos, product and service names, designs, and slogans are trademarks of GRUPOTECA COMPANY LIMITED. You may not use such marks without our prior written permission.

8. Disclaimers and Limitations of Liability

No Guarantees: We cannot guarantee group formation, lender approval, or specific interest rates.

Third-Party Decisions: Lenders make independent decisions about loan approval and terms.

Market Conditions: Interest rates and lending criteria may change during the process.

Exclusions: To the maximum extent permitted by applicable law, GRUPOTECA COMPANY LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, revenue, or business opportunities

Loss of data or information

Loss of or damage to reputation

Business interruption or loss of business

Any claims arising from lender rejection or delays

Maximum Liability: As our service is free for users, our total aggregate liability to you for any claims arising from or related to these terms shall not exceed €100, except where prohibited by applicable law.

Legal Exceptions: Nothing in these terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of obligations implied by Irish Sale of Goods and Supply of Services Act 1980; or (d) any other liability that cannot be excluded or limited under applicable law.

Service Availability: We do not guarantee that our platform will be available at all times or that it will be error-free. We may suspend, withdraw, or restrict availability of all or any part of our platform for business and operational reasons.

9. Data Protection and Privacy

Your data is processed in accordance with our Privacy Policy and GDPR requirements.

We implement enterprise-grade security measures to protect your data.

You have full control over your data and can request deletion at any time.

10. Termination and Suspension

Your Right: You can close your account at any time through your profile settings.

Our Right: We may terminate accounts for breach of terms, fraudulent activity, or legal requirements.

Effect: Active group memberships will be maintained until completion. Personal data will be deleted according to our Privacy Policy.

Account Suspension: We reserve the right to suspend (rather than terminate) your account if:

We suspect fraudulent activity or misuse of the platform

We are investigating a complaint or potential breach of these terms

You have failed to provide requested documentation or information

Your account shows unusual activity that may indicate security compromise

Suspension Process: If we suspend your account, we will notify you via email with reasons for suspension. You may respond with clarification or additional information. We will review your response within 5 business days and either reinstate your account or proceed with termination.

Force Majeure: Neither party shall be liable for any failure or delay in performance due to events beyond reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials. If a force majeure event continues for more than 90 consecutive days, either party may terminate the agreement upon written notice.

11. Dispute Resolution

Governing Law: These terms are governed by European Union legislation and the laws of Ireland. Consumers in Spain retain protection granted by Spanish consumer protection legislation.

Mediation: We encourage amicable resolution of disputes. Consumers in Spain can access the EU Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr).

Jurisdiction: For consumers in Spain, any dispute may be brought before Spanish courts in the consumer's place of residence or before Irish courts. For business users, Irish courts have exclusive jurisdiction.

Severability: If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

12. Regulatory Compliance

GRUPOTECA operates as a lead generation and connection platform between users and financial institutions. We do not provide regulated financial services or financial advice.

We comply with the General Data Protection Regulation (GDPR/RGPD) and applicable data protection legislation in Ireland and Spain.

We apply principles of transparency, clear information about our service, and fair commercial practices in accordance with EU consumer protection regulations.

14. Changes to Terms

We may update these terms periodically. Material changes will be communicated 30 days in advance via email and in-app notification. Continued use constitutes acceptance of updated terms.

Assignment Rights: We may assign, transfer, or delegate our rights and obligations under these terms to any third party without your consent in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. You may not assign or transfer your rights or obligations under these terms without our prior written consent.

Entire Agreement: These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published on our platform, constitute the entire agreement between you and GRUPOTECA COMPANY LIMITED concerning your use of our services and supersede all prior agreements and understandings, whether written or oral.
